Bad Spaniels!
Lately, people are paying more attention to the Supreme Court than they used to, because they’ve recognized that nine Justices can and do affect their everyday lives.
Including what kind of dog toys we can find on the shelves!
In my favorite decision this month, the court decided that Bad Spaniels dog chew toys in the shape of a whiskey bottle infringe the rights of Jack Daniel’s Properties, in part because Bad Spaniels was used like a trademark for a commercial product. This is different from the Barbie Girl song and, more recently, the Victoria’s Secret song, because those clearly spoof or criticize the brands they reference.
Or maybe the Justices simply didn’t like the “Old No. 2 On Your Tennessee Carpet” replacing the “Old No. 7 Tennessee Sour Mash Whiskey”.
Either way, if you’re a content creator, talk to an attorney before releasing a parody.
